These Terms govern access to and participation in programs, camps, clinics, online training, webinars, digital content, and related services provided by King Krosse Incorporated (“King Krosse,” “we,” “us,” or “our”) (collectively, the “Services”).
By registering for, accessing, or participating in any Services, you agree to these Terms.
If the participant is under 18 years of age, a parent or legal guardian agrees to these Terms on their behalf.
1. Services and Participation
King Krosse may offer in-person and online programs, camps, clinics, training sessions, educational content, and other related activities.
Participation in any Service is subject to availability, eligibility, scheduling, safety requirements, and any instructions provided by King Krosse.
King Krosse reserves the right to modify, postpone, reschedule, suspend, or discontinue any Service when necessary.
2. Participant Responsibilities
Participants agree to:
Follow all instructions provided by King Krosse staff, coaches, instructors, and representatives.
Act respectfully toward other participants, staff, facilities, and equipment.
Provide accurate registration and contact information.
Arrive prepared and on time for scheduled activities.
Comply with applicable safety rules and facility requirements.
King Krosse may refuse, suspend, or terminate participation if a participant engages in unsafe, disruptive, abusive, or inappropriate conduct.
3. Parent or Guardian Consent
For participants under 18 years of age, a parent or legal guardian must authorize participation.
The parent or legal guardian confirms that they have the authority to agree to these Terms on behalf of the minor participant.
The parent or legal guardian is responsible for ensuring that the minor participant understands and follows all applicable rules, instructions, and safety requirements.
4. Health, Safety, and Assumption of Risk
Participation in sports, training, camps, clinics, and related activities involves inherent risks, including but not limited to physical exertion, contact with other participants, slips, falls, equipment use, and potential injury.
By participating, the participant, or the participant’s parent or legal guardian where applicable, acknowledges and accepts these risks.
Participants should not participate if they are injured, ill, or otherwise unable to safely engage in the activity.
King Krosse may require a participant to stop participating if continued participation appears unsafe.
5. Medical Authorization
In the event of illness, injury, or emergency, King Krosse may take reasonable steps to assist the participant, including contacting emergency services, a parent or guardian, or an emergency contact.
King Krosse does not provide medical advice, diagnosis, or treatment.
Participants, parents, and guardians are responsible for notifying King Krosse of relevant medical conditions, allergies, limitations, or safety concerns before participation.
6. Online Programs and Digital Content
Online training materials, videos, webinars, documents, playbooks, and other digital content are provided for educational and training purposes only.
Participants may access and use digital content only for personal, non-commercial use.
Participants may not copy, distribute, share, reproduce, sell, publish, or otherwise make King Krosse content available to others without written permission.
Access to digital content may be suspended or removed if these Terms are violated.
7. Intellectual Property
All King Krosse names, logos, materials, training content, videos, documents, methods, designs, graphics, and related materials are owned by or licensed to King Krosse.
Nothing in these Terms grants any ownership rights in King Krosse intellectual property.
Unauthorized use of King Krosse intellectual property is prohibited.
8. Photos, Videos, and Media
King Krosse may capture photos, videos, or other media during programs, camps, clinics, or events.
Where permitted by law and subject to applicable consent requirements, King Krosse may use such media for internal, educational, promotional, or marketing purposes.
Parents, guardians, or participants may contact King Krosse with questions or concerns regarding media use.
9. Communications
By providing contact information, you agree that King Krosse may contact you regarding registration, scheduling, program updates, safety notices, administrative matters, and related Service communications.
You are responsible for ensuring that your contact information remains accurate and up to date.
10. Cancellation or Changes by King Krosse
King Krosse may cancel, modify, postpone, or reschedule a Service due to circumstances including, but not limited to:
Weather conditions
Facility closure
Instructor or staff availability
Safety concerns
Insufficient enrollment
Government restrictions
Force majeure events
Other circumstances outside King Krosse’s reasonable control
King Krosse is not responsible for travel, accommodation, or other personal arrangements made in connection with a Service.
11. User Conduct
Participants and users may not:
Harass, threaten, abuse, or discriminate against others.
Interfere with the operation of any Service.
Misuse King Krosse content, systems, facilities, or equipment.
Share access credentials or restricted materials.
Engage in conduct that creates a safety risk or violates applicable law.
King Krosse may restrict or terminate access to Services if a participant or user violates these Terms.
12. Third-Party Services
King Krosse may use third-party platforms, facilities, tools, websites, or service providers to support registration, communication, scheduling, content delivery, or program operations.
Use of third-party services may be subject to separate terms and policies provided by those third parties.
King Krosse is not responsible for third-party platforms, websites, services, or content that it does not control.
13. Limitation of Liability
To the fullest extent permitted under Alberta law, King Krosse shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the Services.
King Krosse’s liability shall be limited to the fullest extent permitted by applicable law.
Nothing in these Terms limits liability where such limitation is not permitted by law.
14. Indemnification
You agree to indemnify and hold harmless King Krosse, its directors, officers, employees, contractors, coaches, instructors, representatives, and affiliates from claims, losses, damages, liabilities, and expenses arising from:
Your participation in the Services
Your violation of these Terms
Your misuse of King Krosse content or property
Your violation of applicable law
Your conduct toward another participant, user, staff member, or third party
15. Privacy
King Krosse may collect and use personal information in connection with registration, communication, scheduling, safety, program administration, and delivery of Services.
Personal information will be handled in accordance with applicable privacy laws and King Krosse’s Privacy Policy, where available.
16. Governing Law
These Terms are governed by the laws of the Province of Alberta and applicable Canadian federal laws.
Disputes shall be resolved exclusively in the courts located in Alberta, unless otherwise required by applicable law.
Class action or collective proceedings are waived where permitted by law.
17. Digital Acceptance
By registering for, accessing, or participating in the Services, you acknowledge that:
You have read these Terms.
You understand these Terms are legally binding.
You agree to comply with these Terms.
If registering a minor physically, digitally, or by checkbox, you confirm legal authority to bind the minor.
